Cinderhill case goes to High Court

Friends of the Earth Lawyers acted on behalf of Cinderhill Opposition Group to oppose the development of a site in Derbyshire on severely contaminated tar pits.

The development was challenged on a number of grounds - including that the planning permission did not require the developer to carry out remediation schemes.

Council forced to pay legal costs

The local authority finally agreed that there were legal flaws in the planning permission - but would not pay legal charges.

The Council was then given a order by the High Court requiring them to cover costs of the case.

The Rights and Justice team will continue work with Cinderhill Opposition Group to look at any further applications that are submitted for the site.
