Hull incinerator in court again24 November 2009
Friends of the Earth's Rights & Justice Centre lawyers have filed a court case to stop the approval of an incinerator at Salt End (Hull).
Last year our lawyers won a court case on the same incinerator forcing the company and the Environment Agency to start the approval process again.
The case has been brought on behalf of HOTI - a Hull and Holderness based community group that promotes sustainable waste solutions.
New incinerator plan across the UK
The proposed incinerator at Hull is part of a big programme of new incinerators across the UK.
These will be located mostly in poorer areas. This will stop better solutions for climate change and ensure high pollution levels for many years to come.
Incineration damage
The case against the Environment Agency raises some big legal issues about the effect of incineration on climate change.
Incinerators also produce persistent organic pollutants - some of the most dangerous chemicals around.
Taking the case to Europe
Our lawyers also complained to the European Commission on HOTI's behalf.
They argued that the waste contract breached EU competition rules.
As a result of that complaint the local council announced that the incinerator would not receive any more Private Finance Initiative funding.
This means that plans for the incinerator may not go ahead.
The advice we have received from Friends of the Earth's Earth Rights & Justice Centre has been invaluable. We certainly could not have achieved the successes we have had in our challenges to the Environment Agency and the local Councils without their help
