High Court orders developers to stop destroying wood

The High Court today ordered developers to stop felling trees in a community forest in North Durham. Friends of the Earth sought an urgent injunction after Durham Estates started cutting down trees yesterday - shortly after being advised by Trees and Wildlife Action Group and Friends of the Earth that this would be unlawful.
Last week Friends of the Earth Rights & Justice Centre wrote, on behalf of Trees and Wildlife Action Group, to the Forestry Commission and the developer, Durham Estates, warning them that plans to destroy up to five hectares of the forest would be unlawful without a comprehensive environmental impact assessment being carried out. The Forestry Commission was given until 7 July to respond to the legal points raised.
Newbottle Wood in Houghton-le-Spring near Sunderland, is part of the Great North Forest, and one of only 13 community forests in the UK. Developers want to fell the trees to prepare for building 20 football pitches, car parking and associated buildings and infrastructure.
Friends of the Earth's Head of Legal, Phil Michaels, who is representing the group, said:
"We are delighted that the Court has recognised the importance of granting an urgent injunction in this case ensuring that these matters can be resolved by the Court whilst the forest remains intact. It is clear that an environmental impact assessment was required. This forest represents an important green space for wildlife and a resource for the local community. A project such as this should never have been allowed to proceed without a comprehensive environmental assessment."
